Terms and conditions

1. Purpose

These terms govern the sale and the use of the Kestro software, published by the sole trader identified in the legal notice (hereinafter “the publisher”). Any order implies their unreserved acceptance.

2. The software

Kestro is a desktop application that lets you open connections to remote services, monitor the availability of addresses and run commands, from the system menu bar. It runs entirely on your machine.

The minimum requirements are stated on the home page (macOS 11+). The publisher does not guarantee that it will work on earlier versions or on modified systems.

3. Trial period

Kestro may be used free of charge for 7 days, with no bank card and no account creation. The trial gives access to every feature.

At the end of that period, the features that require a licence stop being available. Connections already open are not abruptly interrupted, and your configuration is kept: it is waiting for you should you decide to buy a licence.

4. Licence

The purchase grants a personal, non-exclusive and non-transferable licence to use the software, for professional or personal use.

• A single key is issued per purchase. It activates as many computers as you have bought, simultaneously (1: €39.99 · 2: €54.99 · 3: €69.99, then €14.99 per additional seat up to 25).
• It entitles you to one year of updates from the date of purchase. After that, the installed software keeps working with no limitation and no expiry; only versions released after that date stop being covered. Renewal is optional: there is no automatic charge and no tacit renewal, and not renewing has no effect whatsoever on the software already installed.
• Security fixes remain free beyond the first year, for as long as the software stays reasonably usable.
• It covers the software installed on your machine. Services that would require our servers to run (syncing between computers, keeping data online, working as a team) fall outside this licence: they would be offered separately and billed separately, because they cost money to operate. No feature already present in the version you installed will be moved behind a subscription: whatever your licence runs today will keep running at no extra cost.
• The software works offline. It silently renews its authorisation whenever a connection is available; after a prolonged absence of network, a reactivation may be requested. If your organisation’s network prevents this communication, we issue on request a licence exempt from renewal.
• You can at any time view your active computers and release one from kestro.dev/machine, with no limit on the number. A released seat stops working on the computer concerned.
• You may not resell, rent or redistribute the licence, or share it with third parties. A team must acquire one licence per person.

5. Price and payment

The price is €39.99 for one computer, decreasing beyond that, payable in a single payment. This is an outright purchase, with no subscription and no later charge. A promotional offer (launch offer, end-of-trial offer) may reduce this amount: the discount and the final price are then shown on the payment page before any commitment. Prices in euros are shown inclusive of all taxes; the applicable tax depends on your country of residence. In countries where prices are customarily shown before tax, notably the United States and Canada, the local tax is added at checkout and shown to you before you confirm.

The price may be displayed and charged in your local currency, either at an amount set for that currency or converted from euros at the time of payment. The exact amount is shown to you before any commitment on the payment page.

Stripe Payments Europe, Ltd. and its affiliates act as the seller (“merchant of record”) for this transaction. As such, Stripe is the contracting party for the sale, receives the payment, calculates, collects and remits the applicable tax, and issues the invoice. No bank details pass through our servers, nor are they stored there. The key is issued by email once the payment has been received.

6. Withdrawal and refund

In accordance with article L221-28 of the French Consumer Code, the right of withdrawal does not apply to digital content supplied immediately. The 7-day trial period is precisely what allows you to evaluate the software before any payment.

Beyond that obligation, we undertake to refund any licence on simple request within 14 days of the purchase, with no justification to provide. A request to [email protected] is enough; we pass it on to Stripe, which carries out the refund. The refunded key then ceases to be valid.

7. Liability

Kestro runs commands and opens connections that you configure yourself, with your own credentials and to your own servers. You remain solely responsible for the actions carried out by this means, in particular on production environments.

The software is provided as is. The publisher cannot be held liable for loss of data, service interruptions or indirect damage resulting from its use. Its liability is in any event limited to the amount paid for the licence.

It is up to you to check the commands you save and the environments you connect to. The application flags production connections, but that warning is no substitute for your own vigilance.

8. Support

Support is provided by email at [email protected]. The publisher endeavours to reply within a few working days, without any commitment as to time.

9. Intellectual property

The software, its code, its name and its graphic elements remain the property of the publisher. Buying a licence transfers no ownership right. Decompilation and reverse engineering are prohibited, except within the limits provided for by law.

10. Governing law

These terms are governed by French law. In the event of a dispute, an amicable solution will be sought before any legal action. Failing that, the French courts have jurisdiction.

Consumers: you may use a consumer mediator, free of charge.

11. Changes

These terms may change. The version applicable to your purchase is the one in force on the date of the order.
